Outlines of Consumer and Market Law

Technological innovation and the resulting changes in social habits have made it necessary to adapt the legal framework, comprising principles, rules and protection mechanisms for those most exposed to market risks, to the evolving environment in which consumer transactions now take place.

This increasingly intensive regulatory activity has progressively shaped a systematically organised body of law with a growing degree of autonomy from the other branches of private law.

This volume provides a coherent account of these developments, examining not only the regulation of relationships between consumers and users, on the one hand, and traders, on the other, but also the broader market regulation, including relations among businesses, often operating from markedly unequal bargaining positions, and between commercial operators and public Institutions.

To show the practical implications of this regulation, the analysis adopts a practice-oriented approach through national and European case law.

Antonio Musio is Full Professor of Private Law at the University of Salerno, where he teaches Institutions of Private Law, Consumer and Market Law, Private Law for Markets and Consumers, and Digital Media and Artificial Intelligence Law. He is the author of monographs, articles, case notes, encyclopaedia entries, legislative commentaries, and has edited collective volumes on various areas of private law and, in particular, on consumer law.
